Terms of Service

Terms and conditions as of January 1, 2022.  

HomePhotos.ca provides real estate photography and marketing services and is referred herein as HomePhotos.

By ordering and using services and/or products from HomePhotos, you agree to the following:

Appointments

The client (agent) is responsible for:

  • Ensuring access to the home and property at the scheduled appointment time
  • Ensuring the property is photo ready 
  • Requesting specific rooms/angles/special features to be photographed before the appointment if not meeting the photographer at the scheduled appointment

We will proceed with the appointment regardless of the weather, unless there is a concern for the photographer’s safety.

If the photographer arrives at the property and it is untidy, the photographer will proceed.

If the photographer arrives for a scheduled appointment and the home is not ready for photography (denied entry) or the photographer cannot access the home (e.g. key not available, no one answers the door, etc.), a missed appointment fee of $35 will be charged plus any additional travel fee.

Cancellation

  • The client may cancel a scheduled appointment without being subject to a cancellation fee if the appointment is cancelled before 24 hours of the scheduled appointment
  • Cancellations by the client and/or vendor made within 24 hours of the scheduled appointment, but not less than 1 hour, may be subject to a $15 rescheduling fee
  • Cancellations by the client and/or vendor within 1 hour of the scheduled appointment will be subject to a $35 cancellation fee

Photography

  • Our policy is to take photos of all finished living areas
  • Standard service for photography includes approximately 30-40 minutes of photography time at one designated location for homes under 2,000 sq. ft. and includes 25 to 40 edited photos
  • Homes between 2,000 sq. ft. and 3,000 sq. ft. are subject to an additional fee of $25 as they require more time and will include up to 55 edited photos
  • For homes over 3,000 sq. ft., rural properties over 1 acre or unique homes that require more than 50 photos, please ask for a customized quote
  • Homes are expected to be photo-ready; if the home is not ready and our photographer is delayed more than 15 minutes, either from starting or from continuously shooting (e.g. vendor is still cleaning, client stages each room during the appointment, etc.), an additional fee of $10 per 15 minutes of time is applicable.
  • Living space is based on the square footage noted on the MLS listing plus the estimated living space photographed in the finished basement
  • Generally, 2-3 photos of each main floor principal room, master bedroom and finished basement will be provided along with 1-2 photos of other bedrooms and bathrooms 
  • The client accepts the photo choices made by the photographer unless directed by the client before or during the scheduled appointment for special requests
  • HomePhotos will use its discretion to select and edit the optimal number of photos needed to adequately capture the rooms/features of the home
  • Unfinished areas, laundry/utility rooms and garages are not generally photographed unless requested
  • Unedited photos (i.e. all original photos taken) will not be provided as each photo needs to be edited to our quality standards before any photos are released 
  • If the client is not satisfied with the photos because the home/property was not ready for the photography appointment, the weather was poor or a specific angle/feature was not captured, re-shoot fees will apply
  • If the client is not satisfied with the photos because the photos do not meet our quality standards, the photos will be re-taken at no cost

Virtual Tours

  • All virtual tours will be hosted for at least 1 year
  • It is the responsibility of the agent to update the tour if the property is sold or the agent is no longer the sales representative for the property.  Alternatively, the agent may request HomePhotos deactivate the tour.

iGUIDE

  • The price for an iGUIDE tour is based on the billable square footage drafted in the floor plan.  Any quote provided prior to the floor plan being drafted is considered to be an estimate. 
  • iGUIDE measurements use a time-of-flight laser scanner providing highly accurate measurements with only a 0.5% or less dimensional uncertainty.
  • iGUIDE tours will be ready by the end of the next business day after the appointment.  HomePhotos uses a third-party to host the iGUIDE tour and draft the floor plans.  HomePhotos is not responsible for delays due to extenuating circumstances.

Photo Enhancements

  • We can remove unwanted objects (wires, garbage cans, pets, people in pools, patching grass, etc.).  The cost depends on the complexity but on average it is $15 per photo.   If you request a photo to be “Photoshopped”, we will seek your approval before proceeding if the cost will be more than $15.

Limits of Liability

  • HomePhotos accepts no liability for the accuracy of information presented in online content or in printed feature sheets.  Information is deemed reliable but is subject to verification and is not guaranteed.
  • Under all circumstances, including any dispute or litigation against HomePhotos or any of its principals, subcontractors or employees relating to services provided by HomePhotos, the maximum amount of damages that could be awarded is limited to the amount paid for such services.

Copyright

  • HomePhotos owns all original photographs and edited images, and grants a licence to the client to use photos provided by HomePhotos for activities related to the listing/marketing/sale of the property only; this includes adding photos to the real estate listing (e.g. MLS), online and print advertising, sending to prospective clients and providing a copy of the photos to the homeowner.  The photos may not be provided to any other person, without written consent from HomePhotos.
